The petition against Diana is scheduled for hearing

The Court of Appeal has set a date for the re-examination of the writ
petition filed against the the Minister of State Diana Gamage
requesting to issue an order to revoke her position as a Member of
Parliament.

The judgment of the petition was supposed  to announced today (25) by
the bench of the Court of Appeal consisting of Judge Nishanka Bandula
Karunaratne and Judge A. Marikkar.

But the presiding judge Nishanka Bandula Karunaratne said there is a
split judgment between him and Judge Marikkar. Therefore, he he
ordered that the case will be reheard before a full bench.
Accordingly, the hearing of the petition was postponed to be held on
September 14.

The petition was submitted by Oshala Herath, a social activist
claiming the respondent MP Diana Gamage is a British citizen and
according to the provisions of the constitution of the country, she
has no legal rights to sit in the Parliament of the country.
Therefore, the petitioner had requested the Court of Appeal to rule
that she is not qualified to hold the position as a Member of
Parliament and issue a writ order to invalidate her position as Member
of Parliament.
